Terms and Conditions 

We cherish your faith. To uphold that confidence, Edu-Explorer collects, uses, and protects whatever information you give it with integrity. One of the top educational technology companies, Edu-Explorer was founded in Bangladesh and specializes in teaching. Your usage of "Edu-Explorer" and other related apps, websites, and services run by the company are governed by this privacy statement. Before using the application, please carefully read this privacy policy.

Terms of Use Agreement

Terms of Use Agreement (the "Agreement") governs your use of the Edu-Explorer application ("Application") and other associated applications, products, websites, and services managed by Edu-Explorer ("Company"). Please carefully read this Agreement, which includes the Privacy Policy and the Terms of Use ("ToU") provided on the Application and the Website. Your use of the Website, Application, or services in connection with the Application, Website, or products ("Services"), or registrations with us through any modes, or usage of any products including through SD cards, tablets, or other storage/transmitting devices, signifies your acceptance of this Policy and your agreement to be legally bound by the same. If you do not agree with the terms of this Policy, do not use the Website, Application, our products, or avail any of our Services.

BY USING OR ACCESSING ANY PART OF THE SERVICE, YOU (the "User") AGREE TO ALL OF THE TERMS AND CONDITIONS CONTAINED HEREIN; IF YOU DO NOT AGREE, DO NOT USE OR ACCESS THE SERVICE.

Edu-Explorer reserves the right, at its sole discretion, to modify or replace any of the terms or conditions of this Agreement at any time. It is the User's responsibility to check this Agreement periodically for changes. The User's continued use of the Service following the posting of any changes to this Agreement constitutes acceptance of those changes.

ACCESS

Subject to the terms and conditions of this Agreement, the software, and services provided in connection with the Edu-Explorer Service are solely for the User's own personal use and not for the use or benefit of any third party. Edu-Explorer reserves the right to change, suspend, or discontinue the Services, including the availability of any feature, database, or content, at any time. Edu-Explorer may also impose limits on certain features and services or restrict User's access to parts or all of the Services without notice or liability. Edu-Explorer reserves the right, at its discretion, to modify this Agreement at any time by posting a notice on the Edu-Explorer platform or by sending User a notice via email or postal mail. User shall be responsible for reviewing and becoming familiar with any such modifications. Use of the Service by User following such notification constitutes User's acceptance of the terms and conditions of this Agreement as modified.

User certifies to Edu-Explorer that if User is an individual (i.e., not a corporation), User is at least 13 years of age (provided that, if User is located in a state in which 13 is under the age of majority, then User represents he/she has the legal consent of a legal guardian to enter this Agreement). User also certifies that User is legally permitted to use the Service and takes full responsibility for the selection and use of the Service. This Agreement is void where prohibited by law, and the right to access the Service is revoked in such jurisdictions.

FEES AND PAYMENT

The fundamental Services like experiments or simulations provided by PhET Interactive Simulations, University of Colorado Boulder, https://phet.colorado.edu .  redistributed by Edu-Explorer is offered to users free of charge. However, should the user choose to upgrade to a subscription membership or utilize any of our paid features, or properly utilize the learning of free features, the following terms and conditions shall apply. Edu-Explorer reserves the right to modify its prices at any time.

BILLING AND PAYMENT

Edu-Explorer bills users through an online account for the use of its services. The User agrees to pay Edu-Explorer all applicable service fees using this online account. All fees are exclusive of applicable taxes (e.g., sales, use, or value-added tax), unless otherwise stated, and the User is solely responsible for the payment of any such taxes that may be imposed on their use of the service. Edu-Explorer may rectify any billing errors or mistakes, even if payment has already been requested or received. Edu-Explorer reserves the right to change its prices for certain service features and to introduce new charges at any time, with notice provided to the User, either through email or by posting on the Edu-Explorer platform. The User agrees to maintain current, complete, and accurate information for their billing account. Additionally, the User authorizes Edu-Explorer to obtain updated or replacement expiration dates and card numbers for their credit or debit card, as provided by the card issuer. All fees are final and nonrefundable, including in the event of changes, modifications, diminishment, or removal of any features or functions of any subscribed service. The User shall be responsible for any applicable foreign transaction fees charged by their bank or mobile banking services.

SUBSCRIPTION TERMS

User's subscription to the Edu-Explorer Services will continue indefinitely until cancelled by the User through the cancellation mechanisms provided on the Edu-Explorer Application. After the initial subscription period and subsequently after any renewal period, the User's subscription will automatically continue for an additional equivalent period, at the price agreed upon during the initial subscription. It is only applicable on services that avails auto renewal features. The User acknowledges and agrees that their account will be subject to this automatic renewal feature. If the User does not wish for their account to renew automatically or wishes to change or terminate their subscription, they can log in and navigate to the Change/Cancel Membership page. If a subscription is cancelled, the User may use the subscription until the end of the then-current subscription term, and the subscription will not be renewed thereafter. However, the User will not be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period.

By subscribing, the User authorizes Edu-Explorer to charge their credit card, debit card, or other payment method at such time and again at the beginning of any subsequent subscription period, including any applicable sales or similar taxes imposed on the subscription payments. Upon the renewal of the subscription, if Edu-Explorer does not receive payment, the User agrees that Edu-Explorer may either terminate or suspend their subscription and continue to attempt to charge their payment method provider until payment is received. If the User does not terminate the subscription and/or continues to use the Service, the User agrees that Edu-Explorer is authorized to charge the payment method in the User's Service account. Edu-Explorer may also seek payment directly from the User. Charges may be payable in advance, in arrears, per usage, or as otherwise specified when the User initially subscribes to the Service.

REFUNDS

Users of Edu-Explorer may be eligible for a refund on their current subscription plan if the charge was processed less than or equal to 3 days ago, and the User hasn't used the product since the charge. If the User meets these criteria, they can cancel the subscription and request a refund through their subscription settings page, following the instructions provided in our Help Article. For situations that may qualify for an exception, Users may contact Edu-Explorer Support at support@edu-explorer.com. Exceptional cases are evaluated individually, considering account usage and the date of the charge. Please note that exceptions are one-time courtesies. Users who purchase, cancel, receive a refund (whether through a refund request on their Subscription Settings page or a one-time courtesy exception), and resubscribe at a later date will not be eligible for exceptions on subsequent subscriptions.

PROMOTIONS

Any free trial or other promotion that provides subscriber-level access to the Edu-Explorer Service must be utilized within the specified time of the trial. The User must cancel their auto renewed subscription before the end of the trial period to avoid being charged a subscription fee.

CONTENT

The User acknowledges that all content and materials (referred to as "Content") delivered via the Edu-Explorer Service or otherwise made available by Edu-Explorer on the application are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws. Except as expressly authorized by Edu-Explorer in writing, the User agrees not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such materials or content.

However, the User may print or download a reasonable number of copies of the materials or content at the Edu-Explorer application for their own informational purposes, provided that they retain all copyright and other proprietary notices contained therein. Reproducing, copying, or distributing any content, materials, or design elements on the application for any other purpose is strictly prohibited without the express prior written permission of Edu-Explorer.

The use of content or materials for any purpose not expressly permitted in this Agreement is prohibited. Any rights not expressly granted herein are reserved.SIMULATIONS 

PhET licenses PhET Regular HTML Simulation Files individually under a Creative Commons Attribution 4.0 License .PhET Regular HTML Simulation Files may be freely used and/or redistributed by third parties (e.g. students, educators, school districts, museums, publishers, vendors, etc.) for non-commercial or commercial purposes.

Any use of a PhET Regular HTML Simulation File under the CC BY 4.0 requires the following attribution: “PhET Interactive Simulations, University of Colorado Boulder, https://phet.colorado.edu .”

The CC-BY-4.0 license does not apply to the PhET name and PhET logo, which are trademarks of The Regents of the University of Colorado, a body corporate. See Section III below for additional information regarding how to use legally the PhET name and logo.

RESTRICTIONS

The User is subject to the following restrictions in connection with the use of the Edu-Explorer Service:

Automated Access:

The User shall not use any "deep-link," "page-scrape," "robot," "spider," or other automatic device, program, algorithm, or methodology, or any similar or equivalent manual process, to access, acquire, copy, or monitor any portion of the Service or any Content. This includes any attempt to reproduce or circumvent the navigational structure or presentation of the Service or any Content.

Unauthorized Access:

The User shall not attempt to gain unauthorized access to any portion or feature of the Service or any other systems or networks connected to the Service. This includes hacking, password "mining," or any other illegitimate means.

Security Measures:

The User shall not probe, scan, or test the vulnerability of the Service or any network connected to the Service, nor breach the security or authentication measures on the Service or any network connected to the Service.

Information Gathering:

The User shall not reverse look-up, trace or seek to trace any information on any other user of the Service, or any other customer of Edu-Explorer, including any Edu-Explorer account not owned by the User, to its source, or exploit the Service in any way that reveals information beyond the User's own.

System Overload:

The User shall not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Service or Edu-Explorer systems or networks.

Interference:

The User shall not use any device, software, or routine to interfere or attempt to interfere with the proper working of the Service or any transaction being conducted on the Service, or with any other person's use of the Service.

Identity Manipulation:

The User shall not forge headers or manipulate identifiers to disguise the origin of any message or transmittal sent to Edu-Explorer. The User shall not pretend, through impersonation or otherwise, to be any other individual or entity in connection with the Service.

Unlawful Use:

The User shall not use the Service or any Content for any purpose that is unlawful or prohibited by this Agreement, or that infringes the rights of Edu-Explorer or others.

Inappropriate Content:

Making available any content that is misleading, unlawful, harmful, threatening, abusive, tortious, defamatory, libelous, vulgar, obscene, child-pornographic, lewd, lascivious, profane, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

Harassment and Incitement:

Stalking, intimidating, and/or harassing another person, or inciting others to commit violence.

Criminal Offenses:

Transmitting material that encourages anyone to commit a criminal offense, resulting in civil liability or otherwise breaching any relevant laws, regulations, or codes of practice.

Interference:

Interfering with any other person’s use or enjoyment of the Edu-Explorer application, website, or services.

Intellectual Property Infringement:

Making, transmitting, or storing electronic copies of materials protected by copyright without the owner's permission, committing acts that infringe on intellectual property, or making available any material that infringes on the intellectual property rights or other proprietary rights of others.

Unauthorized Content:

Making available any content or material for which the user does not have the right under any law or contractual or fiduciary relationship, unless the user owns or controls the rights or has received all necessary consents.

Impersonation:

Impersonating any person or entity, or falsely stating or otherwise misrepresenting affiliation with a person or entity.

Malicious Software:

Posting, transmitting, or making available any material that contains viruses, trojan horses, worms, spyware, time bombs, cancelbots, or other computer programming routines that may harm the Edu-Explorer application or services or compromise the interests or rights of other users.

Server Overload:

Accessing or using the Edu-Explorer application, website, services, or products in a manner that could damage, disable, overburden, or impair any of Edu-Explorer’s servers or the networks connected to these servers.

Security Disruption:

Intentionally or unintentionally interfering with or disrupting the services, violating applicable laws related to access or use, violating requirements, procedures, policies, or regulations of connected networks, or engaging in any activity prohibited by the terms.

Unauthorized Access:

Disrupting or interfering with the security of, or causing harm to, the Edu-Explorer application, website, services, or products, gaining unauthorized access to user accounts, passwords, servers, or networks.

Traffic Manipulation:

Using any device, software, routine, or methodology to interfere with the proper working of the Edu-Explorer application, increasing traffic artificially, or accessing, acquiring, copying, or monitoring any portion of the application or website through automated or manual means not specifically made available.

Alteration of Services:

Altering or modifying any part of the services provided by Edu-Explorer.

Unauthorized Use:

Using the services for purposes not permitted by these terms, applicable laws, regulations, or generally accepted practices or guidelines in the relevant jurisdiction.

Violations:

Violating any terms specified under the terms for the use of the Edu-Explorer application, website, services, or products.

Edu-Explorer reserves the right to bar any activity that violates these restrictions.

CUSTOMER REFERRAL BONUS POLICY

In an effort to enhance Customer Retention and Loyalty, Edu-Explorer encourages its Customers, Educational Partners, and other stakeholders to refer potential users to access Edu-Explorer's products and services. Edu-Explorer may, at its discretion, provide a referral bonus, subject to applicable laws. Given that this is an optional and selective policy, the decision of Edu-Explorer is conclusive and not open to dispute or challenge.

It is imperative to emphasize that no Customer, Educational Partner, or other stakeholder should engage in activities with Edu-Explorer in anticipation of receiving a referral bonus. Edu-Explorer will not be held responsible if any Customer engages with the expectation of receiving a referral bonus, as the bonus is solely at the discretion of Edu-Explorer. The decision to provide a bonus is based on internal parameters and various demographic and economic factors.

Customers, Educational Partners, and other stakeholders are advised to approach this policy with caution, understanding that the referral bonus is not guaranteed and is subject to Edu-Explorer's discretionary evaluation. Edu-Explorer retains the right to modify or terminate this policy at any time without prior notice.

By engaging with Edu-Explorer, customers acknowledge and accept the terms of this referral bonus policy.

REGISTRATION; SECURITY

To access certain features of the Edu-Explorer service, users may be required to register and create a username and password ("Edu-Explorer User ID"). Users must provide accurate, complete, and updated registration information. Failure to do so constitutes a breach of this Agreement and may lead to the immediate termination of the user's account. Users are prohibited from selecting or using a Edu-Explorer User ID with the intent to impersonate another person. Additionally, users may not use a Edu-Explorer User ID that is subject to the rights of another person without appropriate authorization. Edu-Explorer reserves the right to cancel or refuse registration of an Edu-Explorer User ID at its discretion. Users are responsible for maintaining the confidentiality of their Edu-Explorer password and other account information.

THIRD PARTY SITES

The Edu-Explorer platform may provide links to other websites or resources on the Internet, and these external sites may contain links to Edu-Explorer. Edu-Explorer has no control over these external websites and disclaims responsibility or liability for their content, functions, accuracy, legality, appropriateness, or any other aspect. Inclusion of any such link does not imply endorsement by Edu-Explorer. Users acknowledge that Edu-Explorer is not responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, information, or services available on or through any external website or resource.

INDEMNIFICATION

Users are solely responsible for their activity in connection with Edu-Explorer. Users agree to defend, indemnify, and hold harmless Edu-Explorer, its affiliates, and their employees, contractors, directors, suppliers, and representatives from all liabilities, claims, and expenses, including reasonable attorneys' fees. This indemnification extends to issues arising from the user's use or misuse of Edu-Explorer, access to any part of the service, any user submissions, or any violation of this Agreement by the user.

LIMITATION OF LIABILITY

Under no circumstances shall Edu-Explorer, its officers, directors, employees, agents, vendors, or suppliers be liable under contract, tort, strict liability, negligence, or any other legal theory with respect to the service (or any content, programs, or information available through the service):

For any lost profits or special, indirect, incidental, punitive, or consequential damages of any kind whatsoever, substitute goods, or services (however arising).

For any bugs, viruses, trojan horses, or the like (regardless of the source of origination).

For any errors or omissions in any content or information or for any loss or damage of any kind incurred as a result of the user's use of any content or information posted, emailed, transmitted, or otherwise made available at or through the service.

For any direct damages in excess of (in the aggregate) $500.00 (U.S.).

In addition, Edu-Explorer shall not be liable for any loss or liability resulting, directly or indirectly, from the user's inability to access or otherwise use the site (including, without limitation, any delays or interruptions due to electronic or mechanical equipment failures, denial of service attacks, processing failures, telecommunications or internet problems, or utility failures).

TERMINATION

Edu-Explorer reserves the right to terminate a user's access to all or any part of the service at any time, with or without cause, effective upon notice thereof to the user. If there is an immediate threat to Edu-Explorer, access may be terminated without notice.

Upon receiving termination notice from Edu-Explorer, the user agrees to:

No longer access (or attempt to access) the service.

Delete all software (and copies thereof) provided in connection with the service.

Provisions of this agreement that, by their nature, should survive termination will continue to do so, including ownership provisions, warranty disclaimers, and limitations of liability.

EXPORT AND TRADE CONTROLS

Users agree not to import, export, re-export, or transfer, directly or indirectly, any part of the service or any information provided on or pursuant to the service except in full compliance with all United States, foreign, and other applicable laws and regulations.

User agrees to abide by the following conditions

1. With the exception of the information specified below, all data, text, images, graphics, software, scripts, audio, and other materials found in the application, website, services, and goods are the exclusive property of the company and are referred to as "proprietary information." Without the company's prior written consent, no proprietary information may be downloaded, copied, reproduced, altered, republished, uploaded, posted, transmitted, or distributed in any way. Additionally, nothing on this application, website, or services should be interpreted as giving the user a license or any other right, interest, or title to any of the company's intellectual property rights. 

2. Your use of our products, Website, Application and Services is solely for Your personal and non-commercial use. Any use of the Application, Website, Services or products or their contents other than for personal purposes is prohibited.

3. It is Your sole responsibility to ensure that the account information provided by you is accurate, complete and latest.

4. Any violation by You of the terms of this Clause may result in immediate suspension or termination of Your Accounts apart from any legal remedy that the Company can avail. In such instances, the Company may also disclose Your Account Information if required by any Governmental or legal authority. You understand that the violation of these Terms could also result in civil or criminal liability under applicable laws.

5. The Company has the right to change modify, suspend, or discontinue and/or eliminate any aspect(s), features or functionality of the Application or the Services as it deems fit at any time without notice. Further, the Company has the right to amend these Terms from time to time without prior notice to you.

6. We welcome User contributions to some interactive areas of the Services, however they might not always be edited before being uploaded. The Company disclaims all liability and responsibility for any content shared in this manner by third parties.

7. Upon registration through any means whatsoever, the Company may contact You through the registered mobile number or e-mail or any other mobile number or contact number or email provided by You to enable effective provision of Services

8. Any feedback You provide with respect to the Application shall be deemed to be non-confidential. The Application shall be free to use such information on an unrestricted basis. 

9. When You use our products and services, the Company will not be held liable for any loss or damage to your tablet or any other hardware, software, or instrument—including any loss of data or impact on processing speed.

10. All notices served by the Company shall be provided via email to Your account or as a general notification on the Application.

MEMBER DISPUTES

Users are solely responsible for their interactions with other Edu-Explorer users. Edu-Explorer reserves the right, but has no obligation, to monitor disputes between users. In case of a dispute with one or more users, the user releases Edu-Explorer (and its officers, directors, agents, subsidiaries, joint ventures, and employees) from claims, demands, and damages (actual and consequential) arising out of or connected with such disputes. 

COPYRIGHT

All content included on the Edu-Explorer platform, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Edu-Explorer or its content suppliers and is protected by national and international copyright laws. The compilation of all content on the platform is the exclusive property of Edu-Explorer and is protected by national and international copyright laws. All software used on (or provided through) the platform is the property of Edu-Explorer or its software suppliers and is protected by national and international copyright laws.

ELECTRONIC COMMUNICATIONS

By visiting the Edu-Explorer platform or sending e-mails, users are communicating with Edu-Explorer electronically. Users consent to receive communications from Edu-Explorer electronically. Edu-Explorer will communicate with users by e-mail or by posting notices on the platform. Users agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirements for written communication.

MISCELLANEOUS:

In the realm of Edu-Explorer in Bangladesh, this section outlines the finer details. If a party fails to exercise a given right, it's not a waiver of further rights. Edu-Explorer is not held responsible for uncontrollable failures, be they mechanical or electronic. Unenforceable provisions will be adjusted without compromising the agreement. User cannot transfer this agreement without Edu-Explorer's written consent, while Edu-Explorer holds the right to transfer it. Governed by Pennsylvania laws, with jurisdiction in San Francisco, California, disputes are settled through arbitration under JAMS rules. This agreement stands as the sole understanding, replacing all prior agreements. No agency or partnership is formed, and any modifications must be in writing and mutually agreed upon.

Refund Policy

2. Refund Request: After canceling the subscription, users can request a refund through the same Subscription Settings page, following the detailed instructions provided in our Help Article.

Exceptions and Special Cases

For situations that may qualify for an exception to the standard refund policy, users are encouraged to reach out to Edu-Explorer Support at support@edu-explorer.com. Exceptional cases are reviewed on a case-by-case basis, taking into consideration the user's account usage and the date of the charge.

It's important to note that exceptions are considered one-time courtesies. Users who have previously purchased, canceled, received a refund (whether through a refund request on their Subscription Settings page or a one-time courtesy exception), and then choose to resubscribe at a later date will not be eligible for exceptions on subsequent subscriptions.

Refund Evaluation Criteria

When reviewing exception requests, Edu-Explorer considers the following factors:

1. Account Usage: The extent to which the user has utilized the features and services during their subscription period.

2. Date of Charge: The specific date when the charge was processed and the proximity to the user's refund request.

Final Considerations

Please be aware that our refund policy is designed to be fair and transparent, providing users with options for refunds under specific circumstances. We recommend that users carefully review their subscription and usage details before initiating a refund request to ensure alignment with the eligibility criteria.

Cancellation Policy

1. Billing Cycle: The cancellation will be effective at the end of the current billing cycle. Users will retain access to the subscribed features until the end of the paid period.

Subscription Renewal

Upon cancellation, users will no longer be automatically billed for the subscription. However, users can choose to resubscribe at any time by following the standard subscription process available on the Edu-Explorer platform.
